Davy Crockett Had It Right

Constitutionality Of Federal Disaster Aid

Reacting to the recent tsunami disaster from his Prairie Chapel Ranch in Crawford, Texas, President Bush said he and Laura were shocked and saddened by this terrible loss of life. He said: "We pledged an initial $35 million in relief assistance." He noted, proudly, that in 2004, the U.S. Government had provided $2.4 billion in food, cash, in humanitarian relief, to cover disasters the previous year. He said that providing 40 percent of all the "relief aid" given in the world in 2003 shows "we're a very generous, kindhearted nation."

"We?" Did Mr. Bush mean he and Mrs. Bush have pledged $35 million? No. Mr. Bush meant that $35 million worth of your hard-earned Federal tax dollars and mine have been pledged. In an interview on the CBS "Early Show," Secretary of State Colin Powell said that to deal with the tsunami disaster the U.S. was sending nine P-3 reconnaissance planes and a dozen C-130s. He added: "I think a lot more aid is going to be needed."

In another interview, on NBC's "Today" show, Secretary Powell was asked: Is the United States prepared to send aid which might be as much as $1 billion? He replied: "I can't answer that yet." In yet one more interview, on the Cable News Network, he said: "The United States is not stingy. We are the greatest contributor to international relief efforts in the world."

Understand now, that to use the term "the United States is" in this context grammatically refers to the corporation known as the United States Government.

At the risk of being misunderstood, and being falsely accused of being cruel, and hard-hearted, what must be said must be said. The issue here is not whether the American government is "stingy." And the issue is certainly not whether the people of these united States are a "generous" people. We most definitely are. Even now in a spirit of generosity, many of us are personally giving of our time, talent and fortune to help those affected by this terrible disaster.

The real issue here is whether disbursement of such so-called Federally funded disaster "relief" is within the powers granted by the Constitution. And the answer is very clear: No, it is not. There isn't the slightest Constitutional authority for Federal tax dollars to be spent for disaster "relief." Thus, any such expenditure of Federal tax dollars for disaster "relief" --- foreign or domestic --- is illegal, unlawful.

Pondering what Mr. Bush and Secretary Powell had said, one needs to think about Tennessee Congressman Davy Crockett (remember him?). In the early 1800s, the U.S. Congress was considering a bill to appropriate tax dollars for the widow of a distinguished naval officer. It seemed that everyone in the House of Representatives favored it.

Then Rep. Crockett spoke. He began by expressing his respect for the deceased. But, he insisted, such respect must not lead to an act of injustice against those still alive.
He continued:

"I will not go into an argument to prove that Congress has no power to appropriate this money as an act of charity. Every member upon this floor knows it. We have the right, as individuals to give away as much of our own money as we please in charity, but as members of Congress we have no right to appropriate a dollar of the public money.

"Some eloquent appeals have been made to us upon the ground that it is a debt due the deceased. Sir, this is no debt. We cannot without the grossest corruption, appropriate this money as the payment of a debt. We have not the semblance of authority to appropriate it as a charity. I cannot vote for this bill, but I will give one week's pay, and if every member of Congress will do the same, it will amount to more than the bill asks."

There was silence on the floor as Rep. Crockett took his seat. When the bill came to a vote, instead of passing unanimously as had been expected, it received only a few votes.

Well, that was then and now is now. President Bush has said what he said and is doing what he's doing. Mr. Bush, however, is wrong and Rep. Crockett was right. To spend Federal tax dollars on disaster "relief" is the grossest corruption because it is blatantly un-Constitutional. It has not the semblance of any Constitutional authority. We must pray that God raises up more Davy Crocketts to serve in our Congress and all other branches of all our civil governments.

Like Davy Crockett, we admire and appreciate the charity of Americans and their leaders. But Congress is not authorized to be "charitable" with your money. Only you are. Think about it.

We Call Them Southrons

January 19. General Robert E. Lee was born on this day in 1807.

Distinguished Georgia Senator, Benjamin Harvey Hill, who made the following remarks in his address before the Southern Historical Society in Atlanta on Feb. 18, 1874 remarked:

"When the future historian shall come to survey the character of Lee, he will find it rising like a huge mountain above the undulating plain of humanity, and he must lift his eyes high toward heaven to catch its summit. He was a foe without hate, a friend without treachery, a soldier without cruelty, a victor without oppression, and a victim without murmuring. He was a public officer without vices, a private citizen without wrong, a neighbor without reproach, a Christian without hypocrisy, and a man without guile. He was a Caesar without his ambition, a Frederick without his tyranny, a Napoleon without his selfishness, and a Washington without his reward."

General Lee left us with the following inspirations:

"It is well that war is so terrible, or we should grow too fond of it."

"Duty then is the sublimest word in our language. Do your duty in all things. You cannot do more; you should never wish to do less."

"The education of a man is never completed until he dies."

"What a cruel thing is war: to separate and destroy families and friends, and mar the purest joys and happiness God has granted us in this world; to fill our hearts with hatred instead of love for our neighbors, and to devastate the fair face of this beautiful world."

"All that the South has ever desired was the Union as established by our forefathers should be preserved and that the government as originally organized should be administered in purity and truth."

"If I had foreseen the use those people designed to make of their victory, there would have been no surrender at Appomattox Courthouse; no, sir, not by me. Had I foreseen these results of subjugation, I would have preferred to die at Appomattox with my brave men, my sword in my right hand."


Reliving Florida's Past

JANUARY 3 1861    Delegates to the Florida Secession Convention meet in Tallahassee to take up the question of secession. Edmund Ruffin of Virginia arrives to confer with Governor Madison Starke Perry and members of the convention.

JANUARY 4 1978    Janet Reno became Florida's first female State Attorney when Governor Reubin O'D. Askew appointed her to head up the Eleventh Judicial District (Miami) when Richard Gerstein resigned. Ms. Reno will be remembered as the Attorney General of the United States under President Clinton.

JANUARY 5 1861    The Florida Secession Convention reconvenes today. John C. McGehee, a passionate state-rights planter from Madison County, is elected permanent chairman. McQueen Macintosh of Apalachicola introduces a resolution declaring Florida's right to secede and urges the passage of a proclamation declaring the state is no longer a part of the United States. The following day U.S. Senator Stephen F. Mallory of Florida recommends that the state's Secession Convention secede. This declaration followed a caucus of Southern senators called by Jefferson Davis and John Slidell of Mississippi.

JANUARY 10 1839    The first Florida Constitution was adopted in the assembly at St. Joseph's (Tallahassee) today and signed by members of the constitutional convention on the day after. Although the document would not become the law of the land in 1839, it provided the basic framework for the first state constitution in 1845.

JANUARY 11 1861    The Ordinance of Secession, approved by the Secession Convention yesterday, was signed today. Florida became an "independent nation" until it joined the Confederate States of America on January 28. Soon-to-be governor, John Milton, unfurls the new flag of Florida, a white silk banner with three stars. The stars represent the three southern states, which have seceded-South Carolina, Mississippi, and Florida.

JANUARY 15 1859    Lake City, formerly known as "Alligator," was incorporated today.

JANUARY 20 1890    The St. John's River railroad bridge, the first major steel railroad bridge in Florida, opened to traffic today in Jacksonville.

JANUARY 22 1908    In Jacksonville, the Kalem Company, organized in 1907, produced what is regarded as the first dramatic film in Florida. The picture was entitled, "A Florida Feud."

JANUARY 24 1989    Convicted serial killer Theodore Bundy was executed today in Starke's Raiford Prison. Bundy died from electrocution in "Old Smokey." On July 23, 1979, Bundy was convicted of the murder of two co-eds at Florida State University. During a period of 15 years, it is suspected that Bundy killed more than thirty young women in Washington, Utah, Colorado, and Florida.

JANUARY 25 1814    Petitioners representing the "Republic of East Florida" asked Congress to admit their republic, with its capital at Fernandina, into the Union. They were unsuccessful in their quest.

Federal Promises

From one president's promise to another's admonition

Perhaps without consulting the Constitution, Franklin Roosevelt, a Democrat president of the United States, introduced the Social Security Program in the 1930's.
He promised:

1.) That participation in the Program would be completely voluntary.

2.) That the participants would only have to pay 1% of the first $1,400 of their annual incomes into the Program.

3.) That the money the participants elected to put into the Program would be deductible from their income for tax purposes each year.

4.) That the money the participants contributed would be put into an independent "Trust Fund" rather than into the General operating fund, and therefore, would only be used to fund the Social Security Retirement Program, and no other Government program.

5.) That the annuity payments to the retirees would never be taxed as income and,

6.) That the social security number never be used for identification.

Choose which of the above 6 promises are still in effect today. Of course, the answer is "None Of the Above". Although some believe otherwise, a president cannot lawfully make a promise that Congress will do his bidding. And so, over the years the Social Security program in its original form has been abrogated and is an instrument of a breach of trust on the part of the general government that has become a troubled political football to be sure.

Our future is in the hands of God and managing our old age should be our own business. Governments should have no authority to dictate to us how we shall be kept up in our old age nor do we agree that they have any authority to "allow" us do this or that with our own money. If we want to invest it personally, that is our business. The booming economy that would come with this righteous windfall would be enormous.

Every tenet of our contract with the Federal Government has been broken, as you can see. The Social Security Number has become a form of ID, and a laughing-stock indeed. It has deprived good citizens of their natural rights to the extent that they are unable to function as a sovereign person of liberty.

And so, in the name of the God of our Fathers, should we dare to cry out, let our people go and let us out of this old-age tyranny? Remember what God did to Pharaoh when he continually refused that request so many years ago? The same God is with us today.

Warriors of Honor

Whoever came up with the government mantra, 'Our strength lies in our diversity,' was no friend of God, man, or America. While some naively believe it means the importance of having diverse views so that fanaticism doesn't rue the day and that is laudable no doubt, its true meaning lies in the concept of multiculturalism and the redefining of moral and ethical behavior; where very few are perceived to engage in immoral or debilitating acts. This bizarre notion has carried over into national and cultural areas. Rather than elevating the worthwhile ideas and customs from other nations; the foundation of history, culture and philosophy in America are torn down. This is happening in the media, the barrios, and the streets but most especially in the schools.

So-called 'dead white' philosophers and great thinkers are considered passé. This is a grave mistake. God moves through different cultures in different eras. He elevates mankind through his grace and assembling souls to raise nations and ideas. For the last two hundred years or so, it has been America's turn. The attempt to throw out the relevance of Greek and Roman contributions, Christianity, esoteric traditions, advances in political thought from the likes of Hobbes, Dabney, Calhoun and the founding fathers is utter folly.

Call it old fashioned or even crazy, but doesn't strength always lie in union, not in diversity? It's easy to focus on differences but harder to see the common thread.

This humble article is a tribute to one whose presence is not completely understood in the forging of this nation. George Washington had an extraordinary connection to God. Those who knew him felt it.

Baron von Steuben, a Prussian in charge of disciplining the troops, said no European armies could have survived Valley Forge because of such a lack of discipline. Steuben was right; it was their commander-in-chief that held them together. It was his physical presence but more importantly it was the power and Light of God that he drew down.

There are always those who try to tear down heroes and the Christ within. Washington is not free from these baseless attacks.

If you happen to read about 'the freethinking Washington,' you'll notice that many people who knew him did not consider him a Christian. He was a Christian but not like those around him. He was also a deist and mason as well. And so he had a very personal and direct relationship with God, one that went beyond the experiences of most Christians (they were in a sense limited by their beliefs, constrained if you will). His experiences were so profound that they could not be shared. Indeed out of respect for his friends he probably chose not to test their credulity.

Fortunately we can catch a glimpse of the man that Heaven listened to and a Indian Chief once said of "the man who is the particular favorite of Heaven, and who can never die in battle;" in the following, written by Washington at Valley Forge:

"Even if the rest of the world continues to ignore us, we will fight on. For we are fighting not only for ourselves, but for all mankind. We are fighting for freedom and human dignity and the right to worship the God of our choice."

Thoughts on Freedom

British diplomat, Neville Chamberlain once remarked, "There is no freedom; The masters are in bondage to vices which are the natural fruits of their irresponsibility and dedication to their goal of perpetual dominance. The majority is in bondage to vices provided them by their masers, keeping them in hopelessness for exploitation."
