Supreme Court and Ten Commandments ... The Constitution Loses In a few months the Supreme Court will issue an edict from Mount Washington. Regardless of which side the edict from Mount Washington favors there will be one unrepresented side that will lose. That is the U.S. Constitution. Here we see two sides lining up, one side that claims the federal government should deny The Display of The Ten Commandments because the federal government has jurisdiction over all State buildings and property. The other side claims that the federal government should grant The Display of The Ten Commandments because the federal government has jurisdiction over all State buildings and property. It is our opinion that the federal courts have no jurisdiction over State buildings and property unless a lawsuit is filed by another State. It is also our opinion that the federal government (Congress and Executive in addition to Supreme Court) does not have any jurisdiction over religious issues. So a ruling either way or worse yet a split ruling will only further deteriorate our God given rights.
One side will jump with joy, or both sides if it is split ruling, but in fact both sides will lose in the long run. The losing side will simply make the appointment of Supreme Court Justices an even more important partisan political issue; the winning side will do likewise. Why not? With the ruling - government will have established that another right is derived from government, not God and it is theirs to give or take. The Bush Administration has done a major flip flop on the issue. They now support The Display of The Ten Commandments. But two years ago the Bush Administration was opposed to Judge Moore when he claimed that Alabama should make the decision not the federal courts. The following AP article clearly shows how both sides are arguing and have fully accepted that the federal government now has supreme jurisdiction or power over all State buildings and property and religious issues. Notice how the article points out that this ruling will have far reaching impact: "a broad ruling could define the proper place of religion in public life" But Our Founding Fathers had a different view:
Our Founding Fathers clearly meant for the federal government to just stay out of the issue and leave it to each State to decide. In this case - one side argues that Congress shall make no law respecting an establishment of religion and the other side argues that Congress shall make no law prohibiting the free exercise thereof. Neither has figured out that Congress is not involved! So here we have all three branches of the federal government actively or passively letting another Founding Principle go by the way side; Supreme Court will redefine the Constitution without the tedious amendment process; the Executive Branch takes both sides of the issue both times siding with increased federal intervention and Congress sits idly by. What Supreme Court ruling or edict from Mount Washington do we prefer: "That the Constitution prohibits federal government intervention and remand the cases to the State Court of Texas and Kentucky." Guess that we are going to be on the losing end of this edict from Mount Washington. Do we favor The Display of The Ten Commandments? Yes we do. When that answer is given, the question always comes, " ... then why don't you favor a Supreme Court edict from Mount Washington in favor of such Displays?" Our answer is that when the Supreme Court or federal government gives what is not theirs to give, they will someday take it back! They now use UN Treaties and English Court cases to define what the Constitution means. MARCH 12 1812 The Territory of East Florida was declared to be in existence today on Amelia Island. MARCH 17 1969 The Today marked the end of a streak of 768 consecutive days of sunshine in Florida. MARCH 19 1823 United States Secretary of War John C. Calhoun ordered the creation of a road between St. Augustine and St. Mary's. Calhoun also ordered a survey for a road between St. Augustine and Pensacola. MARCH 20 1565 Pedro Menendez de Aviles was named Adelantado, Governor and Captain-General of Florida, today by the King of Spain. MARCH 27 1513 Juan Ponce de Leon sighted the Florida peninsula today, although he would not go ashore until April 2. MARCH 30 1822 The United States Congress established Territorial Superior Courts for Florida. The courts are to be convened at St. Augustine and Pensacola. MARCH 31 1832 The St. Augustine City Council passed an ordinance today authorizing the creation of tax-supported free schools in the city. This is one of the earliest such ordinances in the American South and in the nation. March 16, 2005 marks the 250th birthday of the man who had more to do
with the establishment of our Constitutional republic than any other
single individual, a man known as the "Father of the Constitution" --
James Madison. It is sadly fitting that, in this modern age of widespread
Constitutional ignorance, in this time when the individual rights that our
Founders fought to protect are under daily assault and our individual
liberty is being subsumed by a massive and ever expanding government, that
the birthday of the father of our Constitution should be subsumed in that
catch-all travesty called "President's Day", a day better known for school
vacations and sales at local car dealerships than for honoring the giants
of the 18th century who preserved our liberty. The absence of any public celebration of Madison's
250th birthday is in keeping with our modern-day preoccupation with small
matters, while we ignore the great dangers that confront us. We don't want
to be reminded of how far down the road to serfdom we have traveled, from
those heady days when our liberties were clearly understood and valiantly
defended. Our hypersensitivity has invented a right not to be
offended, and so freedom of speech has been banished from most college
campuses by politically correct totalitarians. Our self-obsession has
invented a right to slaughter over a million innocent unborn babies every
year and has eliminated the concept of morality from public discourse, and
so our most fundamental right to defend our own lives is slowly being
regulated out of existence. Our arrogance has convinced us that we have the
power to drive entire species to extinction and to alter the very climate
of the planet, and so we have lost the right to use and enjoy private property, which is at
the root of all liberty. "I believe there are more

Recently
I was invited by
the Newsletter editors to contribute an article for this month's issue on my 'Thoughts
on Freedom'. If you want to know how hard up they are, just consider that they
came to the most disagreeable curmudgeon in Florida, me, for an article.
Let this be a lesson to everyone.
But
let's talk about whether you, the reader, might
qualify as a freedom fighter. How about me? I'm writing this article
and I'm directing this at you because I'm already guilty as heck. But all joking aside and
not to pick on anyone specifically, I will talk here about how sometimes you can't win
for losing. Last
weekend I went to Pinellas Park, Florida, to participate in the Terri
Schiavo protest along with many other Christians. If you don't know by
now, Terri is a brain damaged women that her husband wants to have legally
killed by removing her feeding tube as she has trouble swallowing from her
injury. There is a lot to this case and you will have to read up on this,
as it's too much for this article and what I actually want to talk about
here.
This past Sunday, I wrote an article for my blog on my website
about my experience Thursday last and yes I realise when you get to read
this it will be a little while later. But I drove with friends a long
distance to be there and I consider this very important. There are many other
important things in this world but sometimes you just have to dive in on
one of them. I chose this one. Now here is the
beef.
A person that wanted to be put on my mailing list for
my weekly articles wrote me back criticizing me for taking up such a poor cause
saying this type of thing happens all the time (so?) and, as there
are 40 million abortions since Roe vs. Wade, why don't I protest that? I sent him
back an e-mail letting him know that I might be up in Tampa Bay again on
Tuesday for further protesting and that since he is so concerned about me
not doing enough, he should meet us there bright and early and lead us in
the protests. I felt like also asking him "and what did you do last
Saturday?". The thing
is, folks, we don't need to jump all over those that ARE doing something. I
personally spend a huge part of my life on the freedom issues in America
and in the Southern Movement particularly as I live in Florida. I travel
almost every weekend doing something actively in the southeast United
States, as I am concerned and want to be part of organisations working for
the constitutional liberties fought for since
1775. I'm going to
be a little direct here and say that the problem isn't here with me or with
others that are out there in the mud and struggling against the odds. The
problem is the overwhelming numbers that sit in front of their TV and do
nothing, ZIPPO, and then belittle us when we don't do enough according to
some nut behind his computer. But this is par for the course these
days. But now I have
to ask you again. What have you done lately? Don't tell me about your Vietnam
experience, your Iraqi shootouts last year (shouldn't we be over
killing them anyway), but what are you doing now? If you have feelings
that maybe you could be doing more, check out the Florida League of the
